This is an email I sent a few days ago to support@newsgator.com but went unanswered. I'm hoping someone here can answer my questions?
Hello NewsGator team,
I'm currently developing a non-commercial application using your NewsGator API, and I have some questions about the API License Agreement. FYI, the application is a tray icon kinda like GMail Notifier that checks the newsfeeds from a NewsGator online subscription and shows a popup with the new unread feeds in it. So, here are my questions:
1. Could you explain a bit what is meant in article 1.3 License and Service Agreement? Does this mean I have to present the users of my application a license that they have to agree to? 2. Does article 1.6 also apply to non-commercial software? So when my little application is finished, I should first send it to NewsGator for approval before publishing any binaries? 3. Article 2.3 says to prominently display NewsGator's logo in a non-commercial application. So is there a place somewhere where graphical files of the NewsGator logo can be found? 4. I couldn't find anything about this in the license agreement, but is there a limit to how many times a day/hour/... an instance of a NewsGator client can poll the service? (Eg the minimum setting of polling in my tray icon is every 30minutes)

| IANAL, so I'm going to have to wait on the real lawyers to answer your first 2 questions. I've referred the 3rd item on to marketing, bad oversight on our part, sorry about that. We'll make the artwork available ASAP. As far as item #4, the generally accepted practice among aggregators is to check news hourly. I think 30 minutes is an acceptable minimum - bear in mind that we poll for content only on an hourly basis, so individual feeds won't update more than hourly, though your subscriptions will update throughout the hour.

Gordon, thanks for the answer. I just got a reply back from the support team with answers to the legal questions, so I'll post them here too. He (Dan B) didn't have a reply on the last issue, so your reply was still helpful.
-- From the Newsgator Support Team (1). The End User of any api developer must be notified of certain conditions as well as be provided a link to the NewsGator copyright agent page (these conditions are described in section 1.3, part c & d). If the developer is only providing an add-on to a NewsGator service, which means the end user is already a NewsGator subscriber, then those end users have already agreed to our TOS. If the api developer’s end users are not NewsGator subscribers, they must be presented and accept the TOS. In either case, the link to the copyright agent page and the notifications in 1.3(c) and 1.3(d) must be provided.
(2) 1.6 states that copies must be furnished *at NewsGator’s request* so the individual does not have to provide. It would be nice if he/she did send us a copy but it is not required.

Small clarification on the hourly update that Gordon mentioned.
If a feed author/source pings our service using, that feed will be processed as soon as possible after the ping regardless of where it stands in the regular update schedule.
